These terms govern your use of 66Relics. By creating an account, browsing listings, placing bids, or listing an item for sale, you agree to everything below. Read carefully.
1. ACCEPTANCE OF TERMS
Welcome to 66Relics ("66Relics," "we," "us," or "our"), an online marketplace and auction platform for classic vehicles, motorcycles, vintage guitars, memorabilia, and parts & accessories (collectively, the "Services"). The Services are operated by 66Relics and are accessible at 66relics.com (the "Site"). By accessing, browsing, registering an account, listing an item, placing a bid, making a purchase, or otherwise using the Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.
These Terms constitute a legally binding agreement between you and 66Relics. You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are accessing the Services on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.
2. DEFINITIONS
- "Auction" — A sale conducted through the platform where items are sold to the highest bidder after a bidding period.
- "Auction Block" — A themed grouping of auction listings that run concurrently or sequentially within a defined window.
- "Bidder" — A registered user who places a bid on an auction listing.
- "Buyer" — A user who purchases an item, whether through an auction or a classified listing.
- "Buyer's Premium" — A percentage fee added to the hammer price of an auction, payable by the winning bidder.
- "Classified Listing" — A fixed-price or best-offer sale format, as distinguished from an auction.
- "Escrow" — A third-party transaction service used to hold and disburse funds between buyer and seller.
- "Hammer Price" — The winning bid amount at the close of an auction, before buyer's premium and other fees.
- "Listing" — Any item posted on the platform for sale, whether as a classified or auction.
- "Reserve Price" — A confidential minimum price set by the seller that must be met for the auction to result in a sale.
- "Seller" — A registered user who lists an item for sale on the platform.
- "Soft Close" — An automatic extension of the auction end time when a bid is placed within a defined window of closing.
- "User" — Any individual who accesses or uses the Services, whether registered or not.
3. USER ACCOUNTS
3.1 Registration
To list items, place bids, make purchases, send messages, or participate in community features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
3.2 Account Types
66Relics offers the following user roles: Window Shopper (guest/unregistered visitor), Wrench-Turner (registered user), and Warden (administrator). Certain features are restricted by role, and 66Relics reserves the right to modify role permissions at any time.
3.3 Account Suspension & Termination
We reserve the right to suspend, restrict, or terminate your account at any time, with or without cause, and with or without prior notice. Reasons for suspension or termination include, but are not limited to: breach of these Terms, fraudulent activity, submitting false information, engaging in off-platform transactions to evade fees, harassment of other users, bid manipulation or shill bidding, or any conduct that we determine harms the platform or its users.
4. LISTINGS & SELLER OBLIGATIONS
4.1 Listing Fees
A non-refundable listing fee (currently $100.00 USD) is required to list an item in an auction block. This fee is payable via Stripe at the time of listing submission and must be paid before the listing is queued for an auction block. Listing fees are separate from any buyer's premium or seller commission.
4.2 Accuracy of Listings
Sellers are solely responsible for the accuracy and completeness of their listings, including but not limited to: vehicle year, make, model, VIN/serial number, mileage, condition, modifications, known defects, title status, and authenticity. Sellers must not misrepresent items, use misleading photographs, or omit material facts. 66Relics may, at its discretion, use AI-assisted tools to generate descriptions or valuations, but the seller remains responsible for verifying all information before publishing.
4.3 Prohibited Items
You may not list any item that is illegal to sell, stolen, counterfeit, or otherwise prohibited by law. This includes but is not limited to: vehicles with altered VINs, fraudulent documentation, weapons, hazardous materials, and items that infringe on intellectual property rights. 66Relics reserves the right to remove any listing at any time without notice.
4.4 Title & Documentation
Sellers must have clear, marketable title to any vehicle or item listed and must be able to transfer that title upon sale. Sellers agree to upload valid title documentation, registration, and any other relevant records as part of the listing process. Failure to produce valid documentation upon request may result in listing removal and account suspension.
4.5 Classification of Vehicles
Sellers must accurately classify their vehicle using the platform's subcategory system, which includes: Classic Vehicle, Classic Project, Fixer-Upper, Parts Only, Gets You to Work, and Commercial/Industrial. Misclassification to attract more bids is prohibited.
5. AUCTION RULES
5.1 Bidding Eligibility
To place a bid, you must be a registered user with a verified account. Bidders may be required to complete additional registration or verification steps (including identity verification and escrow account setup) before being permitted to bid. 66Relics reserves the right to require a deposit or pre-authorization before allowing bids on certain auctions.
5.2 Bid Legally Binding
Every bid placed on 66Relics is a legally binding offer to purchase the item at the bid amount, plus the applicable buyer's premium and any other fees. If you are the highest bidder at the close of the auction and the reserve price (if any) has been met, you are obligated to complete the purchase. Placing a bid without the intention or ability to pay is prohibited and may result in account suspension and legal action.
5.3 Soft Close
66Relics auctions use a soft close mechanism. If a bid is placed within a specified window (default: 2 minutes) of the auction's scheduled end time, the auction end time will be automatically extended by a set period (default: 2 additional minutes). This process repeats until no further bids are placed during the extension window. The soft close is designed to prevent last-second "sniping" and to give all bidders a fair opportunity to respond.
5.4 Reserve Price
Sellers may set a reserve price, which is the minimum amount they are willing to accept. If the highest bid at the close of the auction does not meet or exceed the reserve price, the item will not be sold and the seller is under no obligation to complete the transaction. If no reserve is set ("no reserve" auction), the item will be sold to the highest bidder regardless of amount.
5.5 Shill Bidding Prohibited
Sellers, their agents, family members, or any party acting on the seller's behalf are strictly prohibited from placing bids on their own listings to artificially inflate the price. This practice, known as shill bidding, is illegal and will result in immediate account termination, forfeiture of listing fees, and potential legal action.
5.6 Auction Block Scheduling
66Relics organizes auctions into themed "blocks" (e.g., Muscle Car Mayhem, Ghost Guitars, Barn Finds, Cadillacs, Trailer Queens). The platform determines the scheduling, sequencing, and duration of auction blocks. Sellers do not control the exact date or time their listing goes live within a block, though every reasonable effort will be made to honor preferences. The platform uses a rolling conveyor belt engine to manage scheduling and may promote queued listings into available slots.
5.7 Starting Bids
Sellers set the starting bid for each auction. The first bid must be equal to or greater than the starting bid. Subsequent bids must exceed the current highest bid by the minimum increment established by the platform.
5.8 Cancellation
66Relics reserves the right to cancel, suspend, or extend any auction at any time, with or without cause, including in the event of technical errors, suspected fraud, or disputes. If an auction is cancelled before its scheduled close, all bids will be voided. If an auction is cancelled after its close due to a platform error, 66Relics will work in good faith with the buyer and seller to resolve the situation.
6. BUYER OBLIGATIONS & FEES
6.1 Buyer's Premium
The winning bidder (buyer) is responsible for paying a buyer's premium on top of the hammer price. The default buyer's premium is 5% of the hammer price, though specific auction blocks may specify a different percentage. The buyer's premium is collected by 66Relics and is separate from the hammer price paid to the seller. The total cost to the buyer is: Hammer Price + Buyer's Premium.
6.2 Payment & Escrow
Upon winning an auction, the buyer must complete payment through the platform's designated payment processors. Auction transactions may be facilitated through Escrow.com to protect both parties. The buyer's premium is due immediately upon the close of the auction and is payable via Stripe. The hammer price (amount owed to the seller) is processed through escrow. Failure to remit payment within the timeframe specified (typically 3 business days for the buyer's premium, and per escrow terms for the hammer price) may result in the transaction being voided, the item being re-listed, and the buyer being held liable for any difference in sale price and associated costs. These payment and escrow provisions apply to auction transactions only — classified sales are handled directly between buyer and seller outside the platform (see Section 7).
6.3 Buyer's Premium Default
If the buyer fails to pay the buyer's premium within the required timeframe, 66Relics may charge the card on file, pursue collection, and/or ban the buyer from future bidding. The buyer's premium is non-refundable once the escrow transaction has been initiated, except in cases of proven seller fraud or platform error.
6.4 Inspection & Due Diligence
Buyers are encouraged to inspect items, request additional information, and conduct independent research before bidding or purchasing. 66Relics is not a party to the transaction between buyer and seller and makes no warranties or representations regarding the condition, authenticity, marketability, or title of any listed item. All items are sold "as is, where is" unless otherwise stated in the listing.
6.5 Shipping & Transportation
Unless otherwise specified in the listing, the buyer is responsible for all shipping, transportation, and delivery costs and arrangements. For vehicles, the buyer is responsible for arranging transport. Sellers are responsible for making the item available for pickup or transport within a reasonable timeframe after payment is confirmed.
7. CLASSIFIED SALES & OFFERS
Classified listings are fixed-price or best-offer sales. There is no listing fee for classified ads. Buyers and sellers are free to arrange and complete their own transactions outside the 66Relics platform — 66Relics does not process payments, collect fees, or facilitate escrow for classified sales. The platform's messaging and offer system may be used to negotiate price and coordinate logistics, but the actual payment and transfer of the item is solely the responsibility of the buyer and seller. 66Relics is not a party to classified transactions and bears no responsibility for payment, delivery, or disputes arising from them. Buyers may submit offers through the platform's offer system; offers are valid for 72 hours unless otherwise specified, and sellers may accept, decline, or counter. Classified listings may be converted to auction listings at the seller's request, subject to the $100 auction listing fee and block availability — at which point all auction rules, escrow, and buyer's premium provisions apply.
8. TRANSACTION & ESCROW
8.1 Escrow Service
Auction sale transactions may be facilitated through Escrow.com, a licensed and regulated escrow service. The buyer's funds (hammer price) are held in escrow until the buyer confirms receipt and inspection of the item. Once confirmed, funds are released to the seller. The buyer's premium is collected separately by 66Relics via Stripe and is not held in escrow.
8.2 Disputes
In the event of a dispute between buyer and seller regarding an escrow transaction, the parties agree to work through Escrow.com's dispute resolution process. 66Relics may, at its discretion, assist in facilitating communication but is not a party to the transaction and bears no responsibility for the outcome. The escrow status may be marked as "held," "released," "refunded," or "disputed" on the platform.
8.3 Release of Funds
Escrowed funds are released to the seller upon the buyer's confirmation of receipt, or automatically after a defined inspection period if no dispute is filed. Buyers who fail to confirm receipt or file a dispute without cause may have their account restricted.
9. PAYMENT PROCESSING
Payments processed through 66Relics (auction listing fees, buyer's premiums, auction hammer prices via escrow, merchandise, and advertising) are handled through Stripe, Inc. and/or Escrow.com. By making a payment, you agree to the terms and conditions of these payment processors. 66Relics does not store your credit card information — all sensitive payment data is handled directly by Stripe. Payment for auction listing fees, buyer's premiums, and merchandise is processed through Stripe. Auction sale amounts (hammer price) are processed through Escrow.com. Classified sales are not processed through the platform — buyers and sellers arrange their own payments directly (see Section 7).
10. MERCHANDISE STORE
66Relics operates a merchandise store powered by Printify, a print-on-demand fulfillment service. Merchandise orders are fulfilled, printed, and shipped by Printify. 66Relics is responsible for the design and storefront but relies on Printify for production quality and shipping. All merchandise sales are final unless the item is defective or arrives damaged, in which case the buyer must contact 66Relics within 14 days of delivery to arrange a replacement or refund.
11. ADVERTISING
66Relics offers advertising opportunities across the site in designated zones (leaderboard on home page, leaderboard on listings page, and sidebar on listing detail pages). Advertisers purchase packages (Basic, Featured, or Premium) and submit creative materials for approval. 66Relics reserves the right to reject or remove any advertisement at any time. Advertising payments are processed through Stripe. Advertising does not influence listing placement, search results, or auction outcomes.
12. USER CONDUCT
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law.
- Submit false, misleading, or fraudulent information.
- Place bids without the intent or ability to pay.
- Engage in shill bidding, bid manipulation, or price manipulation.
- Attempt to circumvent auction platform fees by conducting off-platform transactions for auction listings (classified sales are exempt — see Section 7).
- Harass, threaten, or intimidate other users.
- Impersonate another person or entity.
- Upload viruses, malware, or any malicious code.
- Scrape, copy, or redistribute platform content without authorization.
- Interfere with the proper functioning of the platform.
- Use automated bots, scripts, or tools to place bids or access the platform without express permission.
13. AI-ASSISTED TOOLS
66Relics offers AI-assisted features including listing descriptions, one-liners, valuations, and a virtual assistant ("The Ghost"). AI-generated content is provided for convenience and informational purposes only and may contain inaccuracies. Sellers must review and verify all AI-generated content before publishing. 66Relics is not liable for any losses resulting from reliance on AI-generated valuations, descriptions, or advice.
14. INTELLECTUAL PROPERTY
The 66Relics name, logo, branding, site design, software, and all original content are the intellectual property of 66Relics and are protected by applicable copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works from the platform without our express written permission. User-generated content (listings, photos, comments) remains the property of the user, but by posting it on the platform, you grant 66Relics a non-exclusive, royalty-free license to display, reproduce, and distribute that content on the platform and in promotional materials.
15. DISCLAIMERS
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. 66Relics does not warrant that the platform will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of listings, the quality of items, the ability of sellers to transfer title, or the ability of buyers to pay. 66Relics is not a party to transactions between buyers and sellers and bears no responsibility for the outcome of any transaction. All transactions are conducted at your own risk.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, 66Relics, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount of fees you have paid to 66Relics in the 12 months preceding the claim.
17. INDEMNIFICATION
You agree to indemnify and hold harmless 66Relics, its officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses (including attorney's fees) arising from: (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any law or the rights of a third party, (d) any listing you post, (e) any bid you place, or (f) any transaction you engage in through the platform.
18. PRIVACY
Your use of the Services is also governed by our Privacy Policy, which is incorporated herein by reference. Please review our Privacy Policy to understand our data collection and usage practices.
19. MODIFICATIONS TO TERMS
66Relics reserves the right to modify these Terms at any time. We will post the updated Terms on this page and update the "Last Updated" date. Your continued use of the Services after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
20. GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration administered by the American Arbitration Association in Denver, Colorado. You waive any right to participate in a class action lawsuit or class-wide arbitration.
21. TERMINATION
You may terminate your account at any time by contacting us. 66Relics may terminate or suspend your account and access to the Services at any time, with or without cause. Upon termination, all licenses granted to you under these Terms cease immediately. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) shall remain in effect.
22. MISCELLANEOUS
These Terms constitute the entire agreement between you and 66Relics regarding the use of the Services. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not be considered a waiver. You may not assign these Terms without our consent; we may assign them freely.
